Explanation
Trays, produce trays, crates and boxes made of PPC as well as nets and sacks made of natural materials for ware potatoes in quantities of 4.5 kg or less are subject to system participation because they typically accumulate as waste with private final consumers – i.e. private households and comparable sources of waste generation (within the meaning of section 3 (11) VerpackG) such as food and beverage businesses and commercial kitchens. Comparable sources of waste generation also include artisanal food production businesses whose packaging waste can be collected at the rate that is normally associated with private households in waste bins that do not exceed 1,100 litres ('volume criterion'). Trays, produce trays, crates and boxes made of PPC as well as nets and sacks made of natural materials for ware potatoes in quantities exceeding 4.5 kg are not subject to system participation because they typically accumulate as waste with the food industry (also in retail settings). Retail packaging other than those mentioned above for ware potatoes in quantities of 28 kg or less is subject to system participation because it typically accumulates as waste with private final consumers – i.e. private households and comparable sources of waste generation (within the meaning of section 3 (11) VerpackG). Retail packaging and grouped packaging for ware potatoes in quantities exceeding 28 kg are not subject to system participation because they typically accumulate as waste in large commercial enterprise settings. Examples include big bags or sacks of quantities exceeding 28 kg that are shipped to industrial processors. Shipment packaging for ware potatoes of all kinds typically accumulates as waste with private final consumers – i.e. private households and comparable sources of waste generation and, as such, is subject to system participation.
