Consultation procedures

The Zentrale Stelle Verpackungsregister (Central Agency Packaging Register – ZSVR) organises consultations as part of its statutory duties. The type and scope of each consultation are determined by administrative procedure law and antitrust regulations. These are considered on a case-by-case basis, taking into account the legal implications of each decision and the extent of its impact.

Administrative regulations

The Verpackungsgesetz (Packaging Act) grants the ZSVR the power to set administrative regulations and to issue administrative acts to make certain decisions.

Administrative procedure law does not require consultation procedures for administrative regulations. The administrative regulations set by the ZSVR are generally norm-interpreting. That means that they usually do not have an immediate external impact. The actual impact on competition, however, can be significant. That is why in most cases antitrust law does require consultations.

To give the parties under obligation as per the Verpackungsgesetz the opportunity to make comments in writing, the ZSVR usually publishes draft versions of administrative regulations. Information about these consultations will be published on this page. Following evaluation of the comments received, the ZSVR publishes its administrative regulations as amended.

There are currently no ongoing consultation procedures.

Application procedures

The ZSVR uses administrative acts to issue general decisions on applications that concern classifications.

Electronic tender platform for collection services

Pursuant to section 26 (2) no. 2 VerpackG (Packaging Act), the ZSVR provides access to an electronic systems platform that allows for competition-neutral tendering of collection services as set out in section 23 (10) no. 2 VerpackG.
