Explanation
Retail packaging and grouped packaging for other non-alcoholic beverages in quantities of 12 litres or less typically accumulate as waste with private final consumers – i.e. private households and comparable sources of waste generation (within the meaning of section 3 (11) VerpackG) such as food and beverage businesses, canteens and commercial kitchens. Unless such packaging is subject to deposit under section 31 VerpackG, it is subject to system participation. Single-use beverage packaging of all kinds that is subject to deposit is not subject to system participation.
Regardless of any deposit obligation, packaging for other non-alcoholic beverages with a bundling function is subject to system participation in quantities of 12 litres or less.
Retail packaging and grouped packaging for other non-alcoholic beverages in quantities exceeding 12 litres are not subject to system participation because they typically accumulate as waste in industrial or large commercial enterprise settings.
Shipment packaging for other non-alcoholic beverages of all kinds typically accumulates as waste with private final consumers – i.e. private households and comparable sources of waste generation and, as such, is subject to system participation.
Specials
The exemptions stipulated in section 31 (4) no. 7 VerpackG do not apply to other non-alcoholic beverages.

Delineation criterion
Delineation criterion

Criterion that relates to a specific product and determines whether the shipment, retail or grouped packaging in question is subject to system participation.

For food packaging, that delineation criterion often is quantity. For packaging filled with other products, the delineation criterion tends to be the number/volume or unit of the individual products contained in the packaging. Depending on the product, other criteria may be used within the scope of an overall market assessment to delineate or determine whether the system participation requirement applies to a packaging, such as the stress class in the case of laminate products.
