The discussion currently underway about clearing contracts (termination, two concurrent clearing contracts etc.) has resulted in queries being put to the Zentrale Stelle Verpackungsregister (Central Agency Packaging Register) that suggest outstanding questions and some degree of insecurity present in the industrial and retail sectors. In 2019, the Zentrale Stelle Verpackungsregister will assess the actual volumes for 2018 as set out in the German Packaging Act. In order to transparently clarify the legal situation surrounding volume clearing for 2018, the Stiftung Zentrale Stelle Verpackungsregister instructed the law firm Dentons to prepare an opinion on the following question: does the termination of existing clearing contracts by some dual systems for 2018 also terminate participation in the Clearing House, and/or preclude volumes from being cleared under the umbrella of the Clearing House?
